A professional valuation will reduce the room for dispute between the parties to a property settlement.
We have the experience to provide independent family law property valuations for clients directly, via solicitors, as a jointly appointed expert by both parties and sometimes as a court appointed valuer for both parties. We may appear in court if required where the property value is in dispute. However as an expert appearing in Court we have a duty to the court itself as an independent expert and not an advocate for the individual client. Our duty is to assist the court to finalise the property matter not perpetuate a dispute.
In the Family Court, property valuations can be presented by each party or the valuations can be prepared on a single expert basis. We have the experience to prepare the required reports and abide by court requirements in such matters and present our case at any valuation mediation conference or to the court should that ultimately be required. Valuations may be required at either the current date or a retrospective historical date relating to the commencement or end of relationships.
In any instance where we are appointed as a single or joint valuer via solicitors for one or both parties we are required to have regard to the expert requirements of the Court under the Family Law Rules 2004 specifically part 15.5 which sets out the requirements relating to Expert Evidence and the Federal Circuit Court of Australia Rules relating to Expert reports and evidence:
- Division 7.1.4 – Instructions and disclosures of expert’s reports;
- Division 7.1.5 – Expert witness’s duties and rights
- Division 7.1.6 – Clarification of single expert witness reports
